dedicated army colonel quit after announcing he had an extramarital affair. it's an fbi affair that's sounding alarms. the fbi was investigating some suspicious e-mails and found some e-mails between paula broadwell and david petraeus. broadwell is the woman who wrote his biography. the fbi looks to see whether his communications had been compromised, and they said they had not been. now, petraeus was interviewed by the fbi, but it's not clear if broadwell has been questioned and if she will be. a u.s. official said petraeus was never a target of an investigation and that a tip about an affair led to that probe. now, general petraeus was scheduled to testify next week about the attack on the u.s. consulate in libya. now what happens now that he's gone? suzanne kelly is in washington with that part of this big story. >> susan, as washington reels from the announcement not only that david petraeus is stepping down from the post, but also from the admission he was having an extramarital affair, a u.s. official has said the counter intelligence unit was investigating a tip that he was h

and the breaking news overnight about the veteran fbi agent who took the first investigative steps that could lead to the downfall of cia director david petraeus. brian ross has been following this story. good morning. >> reporter: good morning, amy. the identification of the agent overnight was another piece of the petraeus case puzzle falling into place. it was last may when tampa socialite jill kelley began to get a series of e-mails that made her think someone was stalking her and her friend, cia director david petraeus. so kelley went to an fbi agent she knew personally. 47-year-old fred humphries, whose lawyer tells abc news, humphries was the agent who helped launch the investigation and later went to congress when he thought there was a coverup. >> if we hadn't had an individual who apparently believed in right and wrong with no gray, we may never have gotten to where we are in this case today. >> reporter: the fbi did not tell the white house about petraeus' affair with his biographer, paula broadwell, until the day after the election, even though agents knew about it a month earlier. fbi

. >> reporter: the fbi actually had nope about the affair for months, but under protocol does not have to notify the president especially since it found no criminal wrongdoing or threat to national security. it all started back in may when a close friend of the petraeus family, ll kelley, started receiving threatening anonymous e-mails. the fbi looked into it and discovered they were sent by petraeus' mistress and biographer paula broadwell who felt jealous of this woman. top leaders in washington should have been told, they say. >> to have someone out there in such a sensitive position the fbi thought perhaps could have been compromised or was under the scope, that had to have been brought to the president or the national security council. >> it is very puzzling and i think was a mistake because this thing just came so fast and so hard. and since then it's been like peeling an onion every day another peel comes off. >> reporter: eric cantor knew about the eye fair two weeks before president obama was notified but did not bring it up earlier saying he received the information from only one sourc

, several serious health issues, but jackson is also the subject of fbi and house ethics investigations. so let's bring in cnn legal contributor paul callan to talk a little bit more about this. paul, good morning. >> good morning, randi. >> the fbi is investigating jackson for allegedly misusing campaign funds for personal use, but he hasn't been charged with any crimes. what's he facing, and when are the consequences here? >> well, you know, there are two aspects to this investigation, and we don't know a lot about it, because there haven't been public announcements made by the justice department or the fbi, but one is personal use of campaign funds. there's a claim that he -- his funds were used to transport a mistress apparently back and forth from washington, d.c. to chicago at some point in time. there's a second aspect of the case though that i was looking at, and i think it might be more important. it's a link to governor blagojevich. remember blagojevich was sent to prison for trying essentially to buy senator obama's senate seat when he was elected president, and jackson is sort o
relationships with top military brass. the fbi traced those e-mails become to paula broadwell's computer where they discovered the evidence of broadwell's affair with david petraeus. but it doesn't stop there. abc news has learned that general allen also received an anonymous e-mail traced to paula broadwell painting jill kelley as a seductress. a further look by the fbi into kelley's e-mails revealed hundreds between kelley and general allen. 20,000 to 30,000 pages of communications in all. but a source familiar with the e-mails say they contain no evidence of a sexual relationship. supporting what allen says -- instead, they're described as friendly, perhaps flirtatious, but routine. mostly about meetings with ambassadors and dinner parties. in one note, kelley tells the general she saw him on tv. he responds -- thanks, dear, you're a sweetheart. many e-mails from kelley to general allen's wife. the two couples were good friends. >> until anyone proves otherwise, i believe he did nothing inappropriate. >> reporter: and the white house made clear the president still has faith in general allen
and law enforcement, certainly the fbi to get the enormous amounts of fairly sensitive information about our private online activities, a lot of it without a court order. it looks like in this case it probably did get a warrant, but it also shows the incredible threat to them. we are talking about something that started as a cyber harassment investigation that led to the exposure of thousands of e-mails between broadwell and patreus over a period of years. we now have these archives of all of our communications, which compared to something like a wiretap can reveal vast more information. host: what is needed from a federal perspective to get access to the e-mails? guest: some courts have imposed tighter requirements. federal law says under certain circumstances it can be done with just a subpoena. they do not need to show probable cause of the search her home or tap your phone. only to certify that material that they are looking for is relevant. host: there is something called the electronic communications privacy act. guest: that is the 1986 federal law that provides the framework for c

motivated to investigate those e-mails. something like that should not and would not rise to an fbi probe? >> it's a great question, and what we found out was the way he was being described was really inaccurate. people had initially reported and republican leaders had described him as a whistleblower who came forward, complaining to cantor, house majority leader cantor's office because he was worried the fbi investigation that uncovered an affair by the cia director david petraeus was stalled for political reasons. it was implied he was concerned about the progress of this case and worried about it being shelved improperly. what we found in our reporting is sources very close to humphries and aware of his account, briefed on his information, tell us quite a different story about the agent. he's a tampa agent who had a long-standing sort of social acquaintance with jill kelley, the woman in tampa. he basically forwarded some information to his tampa fbi colleagues about harassing e-mails that were more interesting than everyday harassing e-mails because they mentioned a four-star general.
